I hope that you'll use your position on the Judiciary Committee to help ensure speedy markup and passage of S.1313, the Protection of Homes, Small Businesses, and Private Property Act. By codifying restrictions on the practice of eminent domain that are more explicit and specific than those contained in the Fifth Amendment, this bill would prevent government-sponsored seizure of private property for private use. This shady practice, allowed by the Supreme Court's 5-4 decision in Kelo v. City of New London, is a true example of liberalism run amok. By restricting eminent domain in cases in which federal funds are involved, S.1313 would partially restore a proper, conservative interpretation of the Fifth Amendment, in which government will no longer be able so freely to abrogate rights of private property.
