I hope that you'll support S.1419, the Free Flow of Information Act. This bill would codify reporters' privileges to protect the confidentiality of their sources in federal cases. (In this regard the federal government lags the District of Columbia and 49 states that have established such protections for the press by statute or by case law.) Significantly, S.1419 would not give reporters an unconditional right to ignore subpoenas; reporters still could be compelled to testify when their testimony could prevent imminent harm to national security. New York Times reporter Judith Miller remains imprisoned for her principled refusal to break her pledge of confidentiality in the Valerie Plame Wilson investigation. S.1419 would give future informants and whistleblowers confidence that the reporters with whom they speak won't be subject to such duress.
